1. Making purchases in the Online Shop

1.1. General terms

1.1.1. You must be at least 18 years old to make purchases in the Online Shop.

1.2. The customer's account

1.2.1. To make a contract over the Online Shop, the user needs to make a user account. User account can be made in two ways. The first way is to go to Sign In button and then go to Create New Account. In addition, it can be done also during Check Out process on the Check Out page in Create New Account field.

1.3. How and when a contract is formed

1.3.1. Your order is accepted and a contract is created when we dispatch the goods for delivery you have ordered and not before. For example, a contract is not created when we take payment for the goods you have ordered or when you receive our confirmation that we have received your order.

1.4. Products description

1.4.1. The goods we offer for sale are described as accurately as reasonably possible (including textual description and photographs). Some differences between goods and their photographs may exist amongst other causes due to technical reasons (for example due to taking photographs and settings of your display).

1.4.2. Company may at any time change specification or description of goods without any notice.

1.4.3. Photographs and descriptions of goods are for information purposes only and do not form part of the contract.

1.5. Price

1.5.1. The prices indicated next to each goods offered for sale are in Euros, US dollars or Swiss francs excluding of all tax applicable under laws of Switzerland and excluding any delivery charges and custom duties (if any). The tax will be issued when the goods will cross the border from our abroad country warehouse.

1.5.2. Company may at any time change any price in the Online Shop.

1.6. Payment

1.6.1. You may pay for the order by Bank wire, PayPal, Postcard or credit cards indicated in the shop.

1.6.2. We will debit your account before the goods are dispatched for delivery.

1.6.3. You guarantee that you are authorised to make payment with the method you have selected.

1.6.4. You can choose one of the following currencies: Euro, US Dollar or Swiss franc. The currency rate will be taken of the day of contract.

1.7.2. We deliver goods using the following methods:

DHL Express, DHL Safer, Latvian Post or pick up in the store in Switzerland on the Schwellistrasse 2. 8052 Zuerich. Not for all countries are all the delivery methods possible. The shop will indicate you the possible delivery methods.

1.7.3. Delivery charges may vary and depend on the particular method of delivery you have chosen.

1.8. Cancellation of your order

1.8.1. Until the goods are dispatched for delivery we may reject your order at any time.

1.8.2. If your order is cancelled as described above you have no right to object, claim for performance of that order, claim to compensate damages (if any) or any other claim whatsoever.

1.8.3. You can cancel your order at any time before the production and shipment process is started (we notify you by email when it is started). After you have received the goods you can withdraw by delivering us back not used products within 14 days. The item should not be worn (item worn only to see whether it fits or not is not considered to be worn) should be clean and without any damages. Our return policy does not violate your customer rights.

Delivery of the shipment back to the warehouse for checking is on side of the customer. Swiss customers can deliver to warehouse in Switzerland. Customers from other countries deliver to warehouse in Latvia.

Address for warehouse in Latvia is: Miera iela 27, Auce LV-3708, Latvia.

This does not apply in the case if there is some quality issue from our side, in this case we are taking full responsibility for the transportation costs for sending item to us as well as for sending exchanged item back to you in case if you will be willing to receive one; if not the value of the item will be refunded to you.

Please note that we have set high quality standards for our products and have established an effective quality management system and we are strictly following that our products would comply with set quality standards.

1.9. Withdrawal

1.9.1. You have the right to withdraw from this contract within 14 days without giving any reason.

1.9.2. The general withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. Special withdrawal period are listed below:

1.9.3. To exercise the right of withdrawal, you must inform us ONYXPRO GmbH of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail).

1.9.5. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

1.9.6. If you withdraw from this contract, we shall reimburse to you all payments received from you, excluding the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back and checked that the goods are not used and damaged. This is not related to our production mistakes.

1.9.7. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

2. Guarantee

2.1. Your legal guarantee of conformity of goods starts with receipt of the goods. During this time we will eliminate all faults of the goods you have purchased, provided these faults are manufacture faults (i.e. the goods were produced badly).

2.2. Guarantee does not cover damages resulting from inappropriate use of the goods, normal wear and tear and any other damage that happen not because of our fault.

3. Changes to these Terms and Conditions

3.1. From time to time we may change these Terms of Revocation. We will publish the revised Terms of Revocation on the Online Shop website.

3.2. When making orders you are advised to read the present version of the Terms of Revocation.

3.3. These Terms of Revocation were last modified on 16 September 2015.
